By accessing or using the Forsa Connect platform ("Platform"), including by submitting a profile, purchasing a profile unlock pack, posting a job, submitting an application, or otherwise interacting with any part of the Platform, you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform.
These Terms constitute a legally binding agreement between you and Forsa Connect ("Company," "we," "us," or "our"). Your continued use of the Platform following any update to these Terms constitutes your acceptance of the revised Terms. You also agree to our Privacy Policy, which is incorporated herein by reference.
Forsa Connect is a talent discovery platform that maintains a curated directory of professionals ("People Board") and facilitates connections between Employers and Talent. We are not an employment agency, staffing firm, recruiter, or party to any hiring agreement between an Employer and Talent.
Specifically:
By submitting a profile to the People Board, you represent and warrant that:
(a) All information you provide — including your name, professional history, skills, education, experience level, salary expectations, and any other details — is accurate, complete, and not misleading.
(b) You have the legal right to submit any content you provide, including your resume and profile photo, and that such content does not infringe any third-party intellectual property rights.
(c) You are at least 18 years of age.
(d) You consent to your profile, including your professional photo and anonymized career details, being publicly displayed on the Platform in the manner described herein.
(e) You understand that your contact details (name, email, phone number) will only be disclosed to Employers who have completed a paid Profile Unlock for your profile.
(f) You understand that submission of a profile does not guarantee approval, publication on the People Board, or contact from any Employer.
You are solely responsible for the accuracy and completeness of your profile. Forsa Connect does not independently verify your professional credentials, employment history, educational qualifications, certifications, skills, salary information, identity, or any other claims made in your profile.
Forsa Connect's editorial review process (described in Section 5) does not constitute verification of any information you submit. Misrepresentation of your background, skills, or experience may result in immediate removal of your profile without notice and without refund of any fees you may have paid.
By submitting a profile to the People Board, you acknowledge that Employers may contact you directly following a Profile Unlock. You are under no obligation to respond to any Employer, and Forsa Connect makes no representation regarding your responsiveness or availability. However, you acknowledge that your profile is presented as belonging to a professional who is open to being contacted, and that unresponsiveness to employer outreach may result in the removal of your profile from the People Board at Forsa Connect's sole discretion.
Forsa Connect is not responsible for and expressly disclaims all liability arising from your failure to respond to Employer outreach, your decision to decline a role, or any conduct on your part following an Employer's Profile Unlock.
Forsa Connect manually reviews all profile submissions before approving them for publication on the People Board. This review is performed by a member of the Forsa Connect team and is editorial and qualitative in nature. The review assesses whether a submission:
Approval of a profile for the People Board signifies only that the submission met our editorial standards at the time of review. It does not constitute endorsement, validation, or verification of any kind.
The Profile Review process expressly does not include and should not be relied upon as:
Employers must not treat a profile's presence on the People Board as evidence that the Talent has been vetted, verified, or endorsed by Forsa Connect in any way beyond the editorial review described in Section 5.1. It is the sole responsibility of Employers to conduct any and all screening, verification, background checks, reference checks, and due diligence required before making any hiring decision.
Employers acknowledge and agree that they are solely responsible for evaluating the suitability, qualifications, skills, character, legal eligibility to work, and fitness for purpose of any Talent they contact or engage through the Platform. This responsibility includes but is not limited to:
Forsa Connect provides no warranty, representation, or guarantee regarding the accuracy of any Talent profile. A Profile Unlock grants access to contact information only. It does not transfer any responsibility for candidate vetting to Forsa Connect.
By accessing the Platform as an Employer, you represent and warrant that:
(a) You are authorized to act on behalf of any business or organization you represent.
(b) Any role for which you seek Talent is a legitimate employment or engagement opportunity and complies with all applicable laws.
(c) You will not use Talent contact information obtained through a Profile Unlock for any purpose other than evaluating or pursuing a legitimate hiring engagement.
(d) You will handle Talent personal data in compliance with all applicable privacy laws.
(e) You will not share, resell, or redistribute contact details obtained through a Profile Unlock with any third party.
The presence of an Employer on the Platform, including the display of an Employer's company name or any reference to employer hiring activity, does not constitute endorsement, vetting, or verification of that Employer by Forsa Connect. Forsa Connect does not screen, background-check, or independently verify the identity, legitimacy, intentions, or business practices of any Employer.
Forsa Connect expressly disclaims all liability for any harm, loss, financial damage, emotional distress, or other injury suffered by Talent as a result of contact initiated by any Employer through the Platform, including but not limited to:
Talent are encouraged to exercise their own independent judgment when responding to any employer outreach, regardless of how it is initiated. Talent should verify the legitimacy of any employer independently before sharing additional personal or financial information. Talent expressly acknowledge this risk by submitting their profile to the Platform and by clicking "Submit My Profile for Review," which includes specific acknowledgment language to this effect.
Forsa Connect provides a mechanism to report suspected fraudulent or abusive employer activity via support@forsaconnect.com. We will investigate reports in good faith and may remove offending parties from the Platform at our sole discretion. However, the ability to report such conduct does not create any obligation on Forsa Connect to prevent, detect, or compensate for fraudulent employer conduct, nor does it create any ongoing monitoring obligation.
A Profile Unlock grants the purchasing Employer access to a specific Talent profile's contact information (including email and phone number, if provided) and resume. An Unlock Pack (currently $300 for 5 unlocks) may be applied to any eligible profiles on the People Board.
A Profile Unlock is the purchase of access to contact information. It is not a guarantee of:
Forsa Connect does not issue refunds for Profile Unlocks where the Talent does not respond to Employer outreach. Candidate responsiveness is outside Forsa Connect's control and is explicitly not guaranteed. By purchasing an Unlock Pack, Employers acknowledge and accept this limitation.
Refunds may be considered solely in cases of documented technical error, such as a profile being inaccessible after a successful unlock, or an unlock being charged more than once due to a platform error. Refund requests must be submitted to support@forsaconnect.com within 14 days of the purchase date with supporting documentation.
All payments are processed via Stripe or another third-party payment processor. Forsa Connect does not store, access, or control your full payment information. We assume no liability for payment processing errors, chargebacks, fraud, or disputes arising from third-party payment services.
Talent on the People Board are independent professionals, not employees, agents, or representatives of Forsa Connect. Talent are solely responsible for:
Nothing in these Terms or the Platform's operations creates any employment relationship, agency, partnership, or joint venture between Talent and Forsa Connect.
All Users (both Talent and Employers) agree to:
(a) Provide accurate, complete, and lawful information in any submission, profile, job post, or application.
(b) Not use the Platform for any unlawful, fraudulent, deceptive, or harmful purpose.
(c) Not misrepresent their identity, credentials, organizational affiliation, or intent.
(d) Not submit spam, bulk, or duplicate content.
(e) Not attempt to harvest, scrape, or systematically extract Platform data, including profile data, contact information, or listings, by automated or manual means.
(f) Not share or resell contact information obtained through a Profile Unlock.
(g) Not use the Platform to discriminate against individuals on the basis of any protected characteristic under applicable law.
We reserve the right to remove any profile, listing, submission, or account at our sole discretion and without prior notice for any violation of these Terms or for any other reason we deem appropriate.
By submitting a profile to the Platform, Talent agree that:
(a) Their publicly visible profile information (headline, role category, skills, experience level, location, English level, photo, and bio) will be displayed on the People Board and may be indexed by search engines.
(b) Their private contact details (name, email address, phone number) will only be disclosed to Employers who have purchased and used a Profile Unlock for that specific profile.
(c) Their resume will only be disclosed to Employers who have purchased and used a Profile Unlock for that specific profile.
(d) Forsa Connect may contact them via email regarding their profile status, platform updates, or relevant opportunities. They may unsubscribe from non-transactional communications at any time.
(e) Their data may be processed by third-party AI services for the purpose of resume analysis and profile generation, as described in Section 12.
Full details of how personal data is collected, stored, and used are set forth in our Privacy Policy.
By submitting a resume or profile materials, you acknowledge and consent to the fact that your submitted documents may be processed by third-party artificial intelligence services (including but not limited to OpenAI) for the purpose of analyzing your resume and generating profile fields. Forsa Connect does not control the outputs of such services and is not liable for inaccuracies, errors, bias, or omissions in AI-generated content. You are responsible for reviewing and correcting any AI-generated profile fields before submitting your profile for review.
All content on the Platform not submitted by Users — including the People Board design, branding, copy, layout, code, and functionality — is the exclusive property of Forsa Connect and may not be copied, reproduced, distributed, or used without express written permission.
By submitting a profile or other content to the Platform, you grant Forsa Connect a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your submitted content on the Platform for the purpose of operating the service.
Forsa Connect reserves the right to remove, modify, or decline to publish any profile, job post, application, submission, or account at any time and for any reason, including but not limited to:
Removal does not obligate Forsa Connect to explain its decision or reinstate removed content. Removal of a profile after a Profile Unlock has been used does not entitle the purchasing Employer to a refund.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORSA CONNECT DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
(a) Forsa Connect will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost revenue, lost data, reputational harm, emotional distress, or business interruption, arising out of or related to the use of the Platform, regardless of the theory of liability and regardless of whether Forsa Connect was advised of the possibility of such damages.
(b) Forsa Connect's total aggregate liability to any User for any and all claims arising out of or related to the Platform or these Terms will not exceed the greater of: (i) $100 USD, or (ii) the total amounts paid by that User to Forsa Connect in the six (6) calendar months immediately preceding the event giving rise to the claim.
(c) These limitations apply even if a limited remedy fails of its essential purpose.
You agree to indemnify, defend, and hold harmless Forsa Connect and its officers, directors, employees, agents, and representatives from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) Your use of the Platform in violation of these Terms.
(b) Any misrepresentation in your profile, listing, or any content you submit.
(c) Your contact with, engagement of, or conduct toward any other User of the Platform.
(d) Any violation of applicable law by you.
(e) Any dispute between you and another User of the Platform.
These Terms and any dispute arising out of or related to them or the Platform will be governed by and construed in accordance with the laws of the State of Virginia, United States of America, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or related to these Terms will be brought exclusively in the federal or state courts located in Virginia. You consent to personal jurisdiction and venue in those courts and waive any objection to the same.
Class Action Waiver: To the fullest extent permitted by law, you waive any right to bring or participate in any class action, collective action, or representative proceeding arising out of or related to these Terms or the Platform.
Forsa Connect reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform with a revised "Last Updated" date. Your continued use of the Platform after any such update constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Forsa Connect with respect to the Platform and supersede all prior or contemporaneous agreements, understandings, representations, and communications, whether written or oral, regarding the subject matter herein.
